THE SHORT ANSWER
Gold IRA compliance is an account-and-custody test, not a purity sticker
IRC 408(m) generally treats an IRA's acquisition of a collectible as a distribution, then excepts specified coins and qualifying bullion. Passing the product exception is only one step: the account, trustee or custodian, physical possession, transaction parties and records must also withstand review.
STATUTORY MAP
Start with the prohibition, then prove the exception
| Question | Why it matters | Evidence |
|---|---|---|
| Did the account acquire a collectible? | General distribution rule | Account ledger and exact asset |
| Is the coin specifically excepted? | Coin exception is statutory | Mint authority and exact denomination |
| Does bullion meet required fineness? | Bullion exception uses a market-delivery standard | Product specification and custodian acceptance |
| Who has physical possession? | Trustee possession condition | Custody agreement and vault record |
COINS VS BULLION
Do not replace the statute with an “IRA approved” product badge
The coin exception names statutory categories, including specified U.S. gold coins. The bullion exception covers gold, silver, platinum or palladium bullion meeting the required minimum fineness when physically possessed by the required trustee. These are different routes.
A product can be marketable gold yet fail the selected exception. Conversely, passing a fineness threshold does not approve a self-storage arrangement, dealer relationship or prohibited transaction.
CUSTODY AND CONTROL
Personal access is not the same as trustee possession
The Code's bullion exception expressly ties qualifying bullion to physical possession by a trustee described in the IRA rules. IRS guidance identifies banks and approved non-bank trustees or custodians in the account framework. Before funding, obtain the legal identity of the trustee, depository agreement, insurance scope, allocation method, audit process, withdrawal procedure and complete fee schedule.
A limited-liability company, safe at home or checkbook structure can raise questions beyond metal fineness. This page does not validate those arrangements. Use counsel familiar with retirement-account prohibited transactions before taking control of IRA assets.
ECONOMIC AUDIT
Tax-advantaged structure does not erase product and storage costs
- Compare the dealer ask with a same-time gold reference.
- Record setup, annual administration, depository, insurance and transaction fees.
- Obtain an executable buyback policy for the exact product and quantity.
- Ask whether the custodian restricts dealers, products, vaults or delivery.
- Model liquidation timing and any cash balance required for account fees.
- Reject guaranteed returns, free-metal promotions and pressure to move retirement funds immediately.
CONSEQUENCE
A failed collectible exception can create a deemed distribution
IRS guidance states that when an individually directed account acquires a collectible, the participant is deemed to receive a distribution in the year of acquisition equal to its cost, and the amount should be reported on Form 1099-R. Income inclusion and potential additional tax depend on the participant and account facts. That is why the review belongs before purchase, not after delivery.

FAQ
Gold IRA questions
Can an IRA own physical gold?
IRC 408(m) provides exceptions for specified coins and qualifying bullion. The account, exact product, trustee or custodian, physical possession and transaction must all satisfy applicable rules.
Can I store IRA gold at home?
The statute conditions the bullion exception on physical possession by the required trustee. Do not treat a dealer's home-storage marketing claim as a legal conclusion; obtain qualified advice on the complete arrangement.
Are American Gold Eagles allowed in an IRA?
IRC 408(m) references specified U.S. gold coins under 31 USC 5112, and IRS Publication 590-A identifies one, one-half, one-quarter and one-tenth ounce U.S. gold coins among the exception. Account and custody rules remain separate.
Does 99.5% fineness alone make a gold bar IRA eligible?
No. The statute refers to minimum futures-delivery fineness and trustee possession. Product identity, refiner acceptance, custodian policy, account structure and transaction parties still matter.
What happens if an IRA acquires a non-exempt collectible?
IRS guidance says the acquisition is treated as a distribution in the year acquired, in an amount equal to the cost, with Form 1099-R and possible additional tax consequences.
